Complex Mediation Package

Advanced mediation for legally complex, high-stakes, or sophisticated disputes

Complex Mediation is designed for disputes that require a higher level of preparation, legal insight, and strategic structure. This tier is appropriate when the issues are legally nuanced, financially significant, or layered with risk that demands experienced judgment.


Complex Mediation is conducted by an attorney-mediator with 10+ years of litigation experience and is intended for matters where litigation is a realistic alternative—but not a desirable one.

What Complex Mediation Is Designed For:

Complex Mediation is appropriate when:

  • The dispute involves significant financial exposure or high stakes
  • Legal rights, obligations, or risk assessment play a central role
  • Multiple documents, agreements, or records must be reviewed carefully
  • The matter involves complex contracts, regulatory considerations, or liability issues
  • Parties require a sophisticated negotiation structure informed by legal context
  • Resolution must balance certainty, enforceability, and practical outcomes


Common examples include:

  • High-value contract or commercial disputes
  • Business ownership, shareholder, or partnership conflicts
  • Employment law or executive-level disputes
  • Real estate, construction, or development conflicts
  • Probate, trust, or estate disputes involving contested interests
  • Matters already involving attorneys or preparing for litigation

Duration and Timing

  • Complex Mediation includes unlimited sessions for a 30-day period, starting from the date the mediator is assigned
  • Sessions are scheduled collaboratively based on availability
  • The process may conclude earlier if resolution is reached


Speed is prioritized, but the process will never force premature resolution.

Cost: $2499

  • Fees are per participant, not combined
  • Payment is due prior to mediation commencing
  • In most cases, fees are shared equally between parties. However, if one party wishes to cover the costs for both parties this can be accommodated.
  • The majority of our cases conclude within 30 days. In situations where parties wish to continue working with their moderator beyond the initial period, additional time may be available at a 10% reduced continuation rate, subject to availability.


Pricing is transparent and fixed. There are no hourly charges, hidden fees, or incentives to prolong the process.

  • Separate and joint sessions designed to manage high-stakes negotiations
  • Structured option development and reality-testing of proposals
  • Agreement terms developed with clarity, precision, and enforceability in mind
  • Clear written documentation of all agreements reached


The mediator takes an active, hands-on role in guiding negotiations and maintaining momentum while addressing legal and practical considerations.

Eligibility and Discretion

Smarter Mediation reserves the right to:

  • Decline cases that are not appropriate for mediation
  • Recommend a different service tier if complexity exceeds scope
  • Terminate mediation if participation is not in good faith


Our goal is resolution—not simply proceeding when mediation is unlikely to be productive.

Scope and Limitations

Complex Mediation provides advanced mediation—not legal representation.


It does not include:

  • Advocacy for any party
  • Legal advice specific to individual rights or claims
  • Court filings, pleadings, or appearances
  • Binding arbitration or judicial decision-making


Parties are encouraged to consult independent legal counsel alongside mediation as appropriate.

Confidentiality

All Complex Mediation sessions and communications are confidential, subject to standard legal exceptions that will be explained before mediation begins. 


Mediation discussions are not part of the public record and are designed to encourage open, candid participation.
