Smarter Mediation is a modern mediation company built around people, not procedure. We believe disputes are best resolved by experienced humans who understand nuance, emotion, and real-world constraints.
We replace drawn-out litigation, passive ADR, and cold tech-only platforms with skilled mediators who actively guide the process forward.
Smarter Dispute Resolution (SDR) is our method for resolving disputes faster, fairer, and with outcomes that last. It is built on a simple belief: the best resolutions come from experienced mediators applying a proven framework, not rigid rules or automation alone.
Using the SMART Method, we help parties move beyond conflict toward practical, workable solutions. The focus is always on achieving faster resolutions, better results, and happier clients.
The SMART Method is the foundation of everything we do. It is a purpose-built framework designed to correct the inefficiencies, delays, and adversarial dynamics that undermine traditional dispute resolution.
From the first conversation to final agreement, the SMART Method guides how disputes are structured, how mediators engage with parties, and how outcomes are reached—ensuring the process is efficient, fair, flexible, and focused on real resolution.

Smarter Mediation is always human-led. Our experienced, compassionate mediators take an active role in guiding disputes toward resolution with fairness, balance, and care.
We are deeply invested in helping you reach an outcome you can live with. That commitment is why we offer unlimited mediation sessions —so the focus stays on resolution, not the clock. We are here to support you every step of the way.

We enthusiastically use technology to simplify the mediation process, reduce friction, and save time. Secure document sharing, flexible scheduling, virtual sessions, and efficient communication tools remove unnecessary barriers and delays.
But when it comes to judgment, nuance, and emotional intelligence, humans are smarter. All decisions always remain firmly human-led, with technology supporting the process—not replacing the insight, care, and accountability of an experienced mediator.

Disputes evolve—and so can your process. Whether you need to change pacing, switch mediators, or adjust the structure of sessions, Smarter Mediation adapts without added fees or friction.

ADR is often marketed as “low cost,” but in practice expenses can add up quickly. Hourly mediator fees, preparation time, attorney involvement, and repeated sessions can make ADR far more expensive than parties initially expect.

As ADR has become institutionalized, many processes now mirror the formality of litigation. Strict procedures, lengthy position statements, rigid session formats, and legalistic approaches can reintroduce the complexity ADR was meant to avoid.

Although ADR is generally faster than court, many processes still suffer from delays. Scheduling conflicts, limited mediator availability, and multi-session structures can stretch disputes out for months, undermining one of ADR’s original promises.

Many ADR professionals bill by the hour, creating little incentive to resolve matters quickly. In some cases, longer disputes mean higher fees—an incentive structure that can conflict with the parties’ desire for efficiency.

Traditional ADR can become overly process-driven. Sessions may focus more on following a standard structure than on achieving a practical, lasting resolution that meets the parties’ real needs.

Even outside of court, ADR can still become adversarial—especially when lawyers dominate the process. Positional bargaining, strategic posturing, and threats can replace collaboration, undermining the purpose of ADR.

Many ADR models emphasize strict neutrality to the point of disengagement. Mediators may avoid actively guiding the process, challenging assumptions, or pushing toward resolution—leaving parties stuck without meaningful progress.

There is wide variation in training, experience, and approach among ADR professionals. Outcomes often depend heavily on the individual mediator or arbitrator, leading to inconsistent experiences and results.
